GENERAL TERMS AND CONDITIONS OF RENTAL SERVICE

 

Welcome to Glam for Rent ("Website"). Please read these General Terms and Conditions of Rental Service ("Terms and Conditions") carefully before ordering products ("Products") through the Website.

These Terms and Conditions are important for us and our customer as they set out what we expect from each other in relation to the rentals of Products through the Website. If you need something, contact us through the contact details indicated in the Contacts section of the Website.

The Products on the Website are rented directly by Cloud Titan Ltd.

1. APPLICABILITY AND LEGAL NOTES

1.1 Rentals made through the Website are governed by these Terms and Conditions. If you refuse to accept these Terms and Conditions, you will not be able to order any Product on the Website.

1.2 We keep these Terms and Conditions updated and we amend them every so often. Your order will be governed by the Terms and Conditions in force at the time you place it: so please check them before you order.

1.3 Notwithstanding the invalidity of any provision of these Terms and Condition, all the other provisions shall remain in full force and effect.

1.4 The languages available to place an order are English and Vietnamese.

2. WHO CAN PLACE ORDERS

2.1 You must be at least 18 years old to place an order on the Website and act as a consumer, i.e. a person rents the Products for purposes unrelated to any trade, business or professional activity. Therefore, by registering on the Website and/or placing your order, you confirm to be at least 18 years old and to act as a consumer.

2.2 You can rent the Products on the Website through your registered account by clicking on the Order button and entering your personal data, necessary for billing and shipping.

2.3 Before submitting any order, please verify that the data you entered are correct and complete. If not, we ask you to amend and/or complete them.

3. PLACING AN ORDER – ACCEPTANCE OF AN ORDER

3.1 Clicking on "accept terms and conditions" button whenever making an online purchase constitutes a legally binding contract. Before placing an order on the Glam for Rent Website, Customers are obliged to carefully read all the instructions provided during the purchase process (including the deposit, delivery costs, the conditions for the exercise of the right of withdrawal as well as these General Conditions.

3.2. The steps to complete an order are the following:

a) To place an order, you have to follow a guided procedure which will then display you a page summarizing the Products you wish to order, the price of the rental Products, the applicable VAT, the deposit amount, the payment methods, the delivery method and related costs, the timeframe by which we expect to deliver the Products to you and the details you have provided for shipping and billing purposes;

b) Before submitting your order, please ensure that all the data you have entered are correct. Once you have counterchecked you can complete your order by clicking on the "Confirm" button. If you have any promotion code, remember to enter your promo code before clicking on "Confirm";

c) As soon as we receive your order, we will send you an email confirming the receipt of such order, along with a recap of all the information relating to the Products ordered, the price and the shipping information;

d) The acceptance of your order by us as well as the execution of the contract will take place when the ordered Products are actually shipped. We also reserve the right to refuse acceptance of an Order at our discretion. In particular, we shall not be responsible, in any way, in the event that a Product that has been ordered is removed from the Site following the submission of the relevant Order. It may in fact occur that the Site erroneously displays Products that are not available at that time too.

3.3 Make sure that the emails we send you are not redirected or blocked by spam filters. To this aim, we suggest you to designate us as a "safe sender" to your email client, for example by registering our contact details in your address book, so that our emails shall be able to arrive in your inbox correctly.

3.4 If you have a personal registered account and you have placed your order through that account, you can track the status of your order by logging into your personal area.

4. AVAILABILITY OF PRODUCTS - RIGHT TO REFUSE OR CANCEL THE ORDERS

4.1 All orders are subject to a check of the availability of the ordered Products. If one or more of the ordered Products are not available at the time your order is processed, your order will be deemed valid for the Products that are actually available. In this case, we will contact you directly and let you know how your order has been amended.

4.2 We reserve the right to refuse or decline your order if you do not meet the criteria and/or requirements necessary to order the Products:

• you do not meet the criteria and/or requirements necessary to order the Products;

• your order of Products is placed from or has to be delivered to cities to which we do not ship. We only ship within Ho Chi Minh City;

• there is a report or suspicion of fraudulent or illegal activity;

• we have reason to suspect deceptive and/or fraudulent use of the Products by you on social networks or social shopping apps, such as, but not limited to, Instagram, Facebook, Telegram, TikTok, Snapchat, Pinterest, etc.

5. PRODUCTS CHARACTERISTICS

5.1 The characteristics of the Products are described on the Website within each product sheet.

5.2 Photographs and descriptions of the Products on the Website are approximate and purely informational and, therefore, might not perfectly represent and/or correspond to the real characteristics of the Products, also due to the display settings of your devices.

5.3 The measures, sizes and dimensions shown on the Size Guide are calculated based on the best statistical estimate.

5.4 The chosen first quality brands are from well-known fashion houses, therefore the manufacturers and retail resellers are continuously under strict quality controls. We do not rent products of lower quality.

6. RENTAL PACKAGES AND PRICES

We offer three different rental packages:

• 1-Day-Rental: The customer can rent the Product for 24 hours. The package price is 500.000 VND (five hundred thousand Vietnamese Dong);
• 3-Day-Rental: The customer can rent the Product for 72 hours. The package price is 800.000 VND (eight hundred thousand Vietnamese Dong);
• 1-Week-Rental: The customer can rent the Product for 7 days. The package price is 1.500.000 VND ((one million five hundred thousand Vietnamese Dong).

The prices above are including 10% VAT.

7. PAYMENTS

We accept the following payment methods: bank transfer and cash payment.

If you choose to pay by bank transfer, our staff will provide you the details of the bank account for the execution of the transfer directly at delivery. Our staff will also make a screenshot of the payment confirmation. In case you choose the cash payment option, you can give the rental fee, deposit and delivery costs directly to our staff.

8. PRICES AND SHIPPING COSTS / GIÁ CẢ VÀ CHI PHÍ VẬN CHUYỂN

8.1 All rental prices of the Products indicated on the Website are VAT included.

8.2 The prices indicated on the Website, the payments and the invoices are expressed in Vietnamese Dong (VND).

8.3 The rental packages indicated on the Website do not include deposit and shipping costs, which will be indicated and calculated during the order creation process and before you place the order.

8.4 In case the customer refuses to accept the delivered bag, a one-time fee of 50.000 VND (fifty thousand Vietnamse Dong) will be charged and has to be paid by the customer.

8.5 The shipping costs for a one-time delivery and one-time pick-up of the rental bag is 80.000 VND (eighty thousand Vietnamese Dong) and shall be borne by the customer and paid right after delivery.

8.6 In case there are several bags within one order with different rental packages and delivery and pick-up time, we will charge for every bag delivery and pick-up fee separately. The fee will be charged according to 8.5.

8.7. In case there are several bags within one order with different rental packages, the same delivery time but different pick-up times, we will charge for every additional pick-up a fee of 50.000 VND (fifty thousand Vietnamse Dong). The fee will be calculated in the order and the customer has to pay on delivery of the bags.

9. SHIPPING - DELIVERY TIMES AND PLACES

9.1 Submitted order will be processed from Monday to Friday from 9:00 a.m. to 5:00 p.m. and within 24 hours from when we receive your order.

9.2 Delivery and pick-up hours are from Monday to Friday, 9:00 AM to 5:00 PM daily.

9.3 The Products will be delivered by our delivery staff in accordance with the timeline that we have indicated in the email that confirms the shipment of the order, unless otherwise communicated.

9.4 The delivery and pick-up time are calculated according to the chosen rental period, which means:

• 1-Day-Rental package: Rental time will start at the time the bag is delivered to you. Within 24 hours the bag has to be returned and picked-up by our staff.
• 3-Day-Rental: Rental time will officially start at delivered time and with in 72 hours the bag has to be returned and picked-up by our staff.
• 1-Week-Rental package: Rental time will officially start at delivered time and the returning time is within 7 days.

Our system will calculate the delivery and pick-up time and we will send you an email with the information.

9.5 We only deliver in Ho Chi Minh City.

9.6 Orders placed during the sale or promotion period may be slowed down.

9.7 We do not ship on specific holidays. We will announce the closing hours on official website.

9.8 You can choose between the 3 delivery/pick-up time frames: 09:00 am – 12:00 pm;  12:00 pm – 03:00 pm and 03:00 pm – 05:00 pm. In case we can’t deliver/pick-up the item at your chosen time frame, we will contact and inform you about the most suitable delivery/pick-up time. Please keep in mind that we have a min. 24 hours processing time.

10. CHECK OF PRODUCTS UPON THEIR RECEIPT

Upon receipt of the Products, please check their conformity to the order and that the bag and the security tags are not damaged. If it seems to you that damages to the bag and/or anomalies have occurred during the transport, please do not accept the delivery.

11. RETURNING PRODUCTS

Products must be returned with the original secutiry tags, which must not be cut, broken or altered in any manner whatsoever, and along with any possible original accessory that is provided with (e.g. dustbags, etc.).

Products must also be returned in the same condition in which they were originally shipped, i.e. not damaged, washed or altered in any way. We cannot accept the return of Products that have been damaged in any manner whatsoever.

In case of severe bag damage or scratches, we will retain the deposit and will not provide a refund. In case the bag rental period is extended and the rental fee and deposit are below the value of the bag, we will retain the deposit and charge an additional fee equivalent to the value of the bag. The customer will have to pay the additional amount through bank transfer or cash.

12. PROMO CODES

If you have a promo code, remember to enter it in the relevant field during the guided procedure of submission of the order.

The promo code is strictly personal and it can only be used to rent the Products through the Website. If you have a promo code, you are the sole beneficiary and, therefore, please keep it secret and do not share it with anyone (for example, by posting it on social media).
If we believe you are abusing or have abused a promo code in any manner whatsoever, we reserve the right to cancel your promo code and/or freeze or close your account.

13. INTELLECTUAL PROPERTY

13.1 All the contents on the Website, including the trademark, the registered trademarks and any other graphic, textual, photographic or video content, as well as any other alphanumeric denomination referring or referable to the Products or to Glam for Rent, in any language expressed, are protected by intellectual property rights.

13.2 You are therefore not permitted to use, reproduce, duplicate, copy, publish or modify, for any purpose whatsoever, the content on the Website.

14. PERSONAL DATA

Any personal data that you wish to provide Glam for Rent, directly or otherwise, through the website, including in the context of services provided Glam for Rent will be processed with respect to the fundamental principles of data protection, which include the principles of transparency, minimization, lawfulness and fairness.

15. EVENTS BEYOND OUR CONTROL

15.1 Our liability for non-performance of our obligations under these Terms and Conditions is excluded in case of events beyond our control such as war, fire, earthquake, flood, tsunami, strikes, labor disputes, epidemics, pandemics, internet malfunctions and failures, restrictions on the use of energy, acts of public authority or any other action or cause which we cannot reasonably overcome.

15.2 If such events affect the delivery time of the Products, delivery will be suspended for as long as the event under reference lasts and, in any case, we will contact you by email in order to inform you of the new delivery date.

16. APPLICABLE LAW – DISPUTE RESOLUTION

16.1 These Terms and Conditions and all the rental contracts entered into through the Website are governed by Vietnamese law.

16.2 Any dispute arising out of or in connection with these Terms and Conditions and/or the rental contracts entered into through the Website shall be subjected to the jurisdiction of the Court based in Ho Chi Minh City, Vietnam.
